Esta reseña analiza una serie de reflexiones, elaboradas por doce diferentes autoras, acerca de algunos aspectos sustantivos de las teorías tradicionales de derechos humanos. Estos aspectos son sistematizados en torno a los siguientes apartados: La relevancia de la perspectiva iusfilosófica en la revisión crítica de las concepciones sobre derechos humanos; el problema de la fundamentación de los derechos humanos; el problema del carácter absoluto como propiedad esencial de estos derechos; el temor de que los derechos fundamentales pierdan su papel de (...) límite ante intereses de tipo colectivo; la dignidad humana como principio que posibilita, pero que también restringe, la autonomía individual; el ejercicio efectivo de la autonomía frente al presupuesto del agente autónomo; el problema de la universalidad de los derechos humanos en un contexto de pluralidad y diversidad; la importancia del orden internacional; y el rechazo a una concepción de los derechos y los deberes en términos estatistas y de correlación. This paper aims to offer a definition of excessive profit for cases of exploitation. Most of the literature that aims to identify cases of exploitation focus on determining a fixed price, and suggests that profit is excessive when individuals deviate from this price. More recently, Joe Horton has proposed an indifferent benchmark between transacting with a vulnerable party and not transacting with her. After arguing against the existing focus on prices, the paper proposes an alternative approach to exploitation which focuses (...) on the profit made by the purported exploiter party. It suggests that profit is excessive when an agent makes more profit than the profit that a non-vulnerable purported exploiter would have made when transacting with a non-vulnerable second party. The focus on profit leads to the conclusion that different prices may be non-exploitative depending on the situation of the agents involved. (shrink)

This article presents the results of the evaluations of the mechanical stresses associated with the performance of manual lifting tasks of loads and those operators must endure in their workplaces, considering these the most recurrent cases and positions. This study is based on a static analysis of certainspecific positions of the human body, the transmission of forces through the musculoskeletal structure, and the generation of efforts at critical points of the body. In addition to this, it is considered a revision (...) of the criteria of the Spanish Technical Standard NTP-477. There are critical points of the musculoskeletal structure that support considerable efforts, the recommendations and criteria provided by the NTP-477 are relevant and although limited, provide an adequate margin of safety to avoid injury to workers. The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. New educational practices lead to a vision of educational quality, with new approaches that allow the continuous (...) integration of knowledge and permanent interaction with the student. This paper presents an analysis of the new teaching methodologies in times of confinement due to the pandemic caused by Covid-19. Technical and tactical actions are decisive in terms of badminton player competitive performance. The main objective of this research was to design, validate, and estimate the reliability of an observational instrument for the analysis of the tactical and technical actions in individual badminton. The process was carried out in four different steps: first, there was a review of the scientific literature and a preliminary list of variables was made; second, a qualitative and quantitative assessment was completed by 10 badminton expert (...) judges; in the third step, the content validity was estimated using Aiken’s V coefficient; finally, intra-observer reliability and interobserver reliability were tested by two observers specialized in badminton using the Cohen’s Kappa coefficient and the intraclass correlation coefficient. Strokes were used as the unit of measure by our observational instrument; every time badminton players hit the shuttlecock, 22 variables are observed. The minimum Aiken’s value was 0.58, and reliability was 0.63. In spite of these values, none of the variables had to be removed, but there were modifications in terms of drafting in some of them. The main findings confirmed the validity and the usefulness of this instrument. (shrink)

8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. The book carefully details the settler- colonial ideology and logic of elimination that permeated US territorial expansion over the Northwest Territories at the end of the eighteen and the first decades of the nineteenth centuries. Seeing Red thoroughly examines the complex context of dispossession by the US colonial power, centering on Anishinaabeg communities, the “mix- race” population, and the different Indigenous people inhabiting this region. However, the book focuses on what the author names “unthinkable history,” following Michel- Rolph Trouillot’s argument that this region, and the whole continent, was conceived as an unsettled territory instead of belonging to many Indigenous peoples. Thus, the text explores Indigenous and mixed- raced communities’ political imaginaries and imagined futures to retain autonomy and territory.Author Michael John Witgen is a citizen of the Red Cliff Band of Lake Superior Ojibwe and a professor in the Department of History and the Center for the Study of Ethnicity and Race at Columbia University. His research centers on the complex relations between Indigenous people and settler colonizers in the Great Lakes and the Northwest Territories. Seeing Red expands his previous analysis of race, ethnicity, and citizenship intersections, bringing to the fore Indigenous people’s history to rethink the statemaking process in the United States.This book’s pages show that theft lies at the foundation of wealth transfer from Indigenous territories to the United States government and white citizens. The white settler ideology, based on a “doctrine of discovery,” established a stark division between the civilized and uncivilized to rationalize, among other things, the theft of Indigenous people. This is a central argument of the book that signals how the civili zation project underpinning the territorial expansion of the United States was based on the transformation of commons into private property. Indigenous land became critical in the “political economy of plunder” advanced by the state and the meaning of “native” as a racial categorization of exclusion. Chapter 1 explores this economy of plunder by detailing the advancement of the settler frontier through different [End Page 139] mechanisms, such as the treaty policy— subsequently violated by the state— and territory surveying to make land legible for the state and cheap for settlers. It is worth mentioning that the book contains historical and thematic maps that visually represent the ideology of wilderness behind the colonization project and evidence of the territorial extent of dispossession suffered by Indigenous communities. However, this crusade to dispossess Indigenous peoples from their territory also rested on the national mythology that strengthened the trope of Indigenous vanishing. The author shows how during the years of the study, the Indigenous population was not vanishing but immersed in an intricate social world and transregional trade networks. Chapter 2 explores such context, following the story of an Ojibwe man to evidence the context in which settlers and federal officials relied on Indigenous customs to profit from the fur trade while using ties with communities to further land cessions.Mix- race families played a crucial role in expanding the settler frontier through treaty negotiations but remained marginalized as they identified themselves as both Natives and US citizens. La vocación decisiva de Ortega fue la intelectual o filosófica, en el sentido socrático-platónico, no la del “intelectual” como (...) figura que interviene en asuntos públicos, aunque asumiera ese papel con notable intensidad hasta 1932 o 1933. Desde que la Guerra Civil española estalla decidió no ma- nifestarse sobre temas políticos. Uno de los textos que más a fondo reflexiona sobre la condición del intelectual en el doble sentido indicado fue “El intelectual y el otro” (1940), que dialoga dramáticamente con la circunstancia argentina en la que y para la que fue escrito, pero que tuvo repercusiones en el mundo del exilio republi- cano en la América hispana, especialmente en México. MARINA PAOLA BANCHETTI-ROBINO is Associate Professor and Chair of the Philosophy Department at Florida Atlantic University. Her areas of research include phenomenology, philosophy of language, philosophy of science, philosophy of mind, and zoosemiotics. BERNARD BOXILL was born in Saint Lucia, West Indies where he received his primary and secondary education. Her anthology Enlightened Conversations: Women and Men Political Theorists (Blackwell, 2000) challenges political theorists to be more inclusive of race and gender in their research and teaching. Her book Black Women's Intellectual Traditions: Speaking Their Minds, co-edited with Carol Conaway (University of Vermont Press, forthcoming), addresses the varied intellectual traditions of black women's thought that spans more than two hundred years in North America. En el presente artículo, me centraré únicamente en la ontología del Tractatus porque, a pesar de ser uno de los temas que abandona después de 1930, tiene dos aspectos que quisiera resaltar de manera especial: su carácter relacional, y su afirmación de la contingencia del mundo. The entire Platonic corpus is a setting forth, variously, of the theory of ideas as an answer to the problem of significant speech: how is it possible to assign stable definitions and names to unstable sensible phenomena? As an answer, the theory is anything but neat and tidy because it raises more question. The Parmenides is explicitly about the ideas and thus most appropriately in its speeches as well as its dialogic deeds it raises more questions than it answers. Its (...) proven ability to do so is manifested in the inability of any interpretation to put the dialogue's two halves together into a neat seamless whole. It is the thesis of the dissertation that this difficulty is intentional and inseparable from Plato's presentation of the ideas. Examining what makes it impossible to put the halves together will also reveal the possibility of a connection, and so the dissertation pays close attention to Socrates' speech setting forth his theory of the ideas and Parmenides' demonstration of the dialectical exercise. The current assessment of behaviors in the inventories to diagnose autism spectrum disorders (ASD) focus on observation and discrete categorizations. Behaviors require movements, yet measurements of physical movements are seldom included. Their inclusion however, could provide an objective characterization of behavior to help unveil interactions between the peripheral and the central nervous systems. Such interactions are critical for the development and maintenance of spontaneous autonomy, self-regulation and voluntary control. At present, current approaches cannot deal with the heterogeneous, dynamic and stochastic (...) nature of development. Accordingly, they leave no avenues for real-time or longitudinal assessments of change in a coping system continuously adapting and developing compensatory mechanisms. We offer a new unifying statistical framework to reveal re-afferent kinesthetic features of the individual with ASD. The new methodology is based on the non-stationary stochastic patterns of minute fluctuations (micro-movements) inherent to our natural actions. Such patterns of behavioral variability provide re-entrant sensory feedback contributing to the autonomous regulation and coordination of the motor output. From an early age, this feedback supports centrally driven volitional control and fluid, flexible transitions between intentional and spontaneous behaviors. We show that in ASD there is a disruption in the maturation of this form of proprioception. Despite this disturbance, each individual has unique adaptive compensatory capabilities that we can unveil and exploit to evoke faster and more accurate decisions. Measuring the kinesthetic re-afference in tandem with stimuli variations we can detect changes in their micro-movements indicative of a more predictive and reliable kinesthetic percept. Our methods address the heterogeneity of ASD with a personalized approach grounded in the inherent sensory-motor abilities that the individual has already developed. (shrink)

This paper forges links between early analytic philosophy and the posits of semiotics. I show that there are some striking and potentially quite important, but perhaps unrecognized, connections between three key concepts in Wittgenstein’s middle and later philosophy, namely, complex, rule-following, and language games. This reveals the existence of a conceptual continuity between Wittgenstein’s “early” and “later” philosophy that can be applied to the analysis of the iterability of representation in computer-generated images. Methodologically, this paper clarifies to at least some (...) degree, the nature, progress and promise of an approach to doing philosophy and semiotics from a modally modest perspective that sees in the intellectual products of humanities, and not in unreflective empiricism, the future of scientific development. This hybrid, non-reductionist approach shows, among other things, that semiotic processes are encoded by specific types of complexes in computer-generated images that display iterability in time and space. In this paper, I critique two conceptions of mechanisms, namely those put forth by Stuart Glennan (Erkenntnis 44:49–71, 1996; Philosophy of Science 69:S342–S353, 2002) and Machamer et al. (Philosophy of Science 67:1–25, 2000). Glennan’s conception, I argue, cannot account for mechanisms involving negative causation because of its interactionist posture. MDC’s view encounters the same problem due to its reificatory conception of activities—this conception, I argue, entails an onerous commitment to ontological dualism. In the place of Glennan and MDC, I propose (...) a “modified conception” of mechanisms, which (a) obviates the problem of negative causation by reinterpreting MDC’s activities according to a “descriptivist” account, and (b) avoids MDC’s problem by postulating a monistic ontology of entities. Thus, by solving these problems, my modified conception offers a cogent, more adequate alternative to Glennan’s and MDC’s conceptions of mechanisms. (shrink)

In his new book, Carlos Alberto Torres, an internationally renowned critical theorist of education, explores the early writings of Paulo Freire whose ideas have had a tremendous and long-lasting impact on the world of pedagogy and politics. Torres analyzes Freire's works, from the 1960s and 1970s, before Freire gained worldwide recognition for his Pedagogy of the Oppressed. Offering an in-depth look into the formative thinking of Freire, Torres identifies how his ideas produced frameworks for educating global citizens, (...) building community and mutual respect, creating social responsibility, instilling an appreciation for diversity, promoting multiple literacies, and social justice education. This volume is the result of more than 3 decades of research with access to Freire's personal library and the archives of the Paulo Freire Institute, as well as the author's extensive conversations with Paulo Freire over two decades--Dr. Torres was Freire's adviser during his tenure as Secretary of Education in the Municipality of São Paulo, Brazil, 1989-1991. As noted in Part 1 of this two-part review, school attendance is an important foundational competency for children and adolescents, and school absenteeism has been linked to myriad short- and long-term negative consequences, even into adulthood. Categorical and dimensional approaches for this population have been developed. This article (Part 2 of a two-part review) discusses compatibilities of categorical and dimensional approaches for school attendance and school absenteeism and how these approaches can inform one another. The article also poses a multidimensional (...) multi-tiered system of supports pyramid model as a mechanism for reconciling these approaches, promoting school attendance (and/or prevention of school absenteeism), establishing early warning systems for nimble response to school attendance problems, assisting with global policy review and dissemination and implementation, and adapting to future changes in education and technology. This article introduces Agentive Cognitive Construction Grammar, an emerging field that seeks to connect the linguistic system with speaker-meaning. The stated purpose is thus to tackle a pervasive disconnect in both cognitive linguistics and construction grammar, whereby the linguistic system and speaker selections are separated in the belief that language is essentially a mental process associated with the brain, and hence, separated from bodily experience. I contend this view by introducing a triadic model of construction in which form and function (...) are inextricably bound up with agency. This is possible because language is tethered to senses of movement and balance that connect experiences with the physical world with the mental. A major insight of the paper is that argument structure constructions partake of both linguistic and non-linguistic signs, which provides speakers with a means to verbalize their thoughts and distribute agency in specific events. One important limitation of the current renditions of interpretivism is that its emphasis on the moral dimension of sport has overlooked the aesthetic dimension lying at the core of this account of sport. The interpretivist’s failure to acknowledge and consider the aesthetic implicitly distances this realm from the moral. Marcia Muelder Eaton calls this distancing the separatist mistake. This paper argues that interpretivism presupposes not only moral but also aesthetic principles and values. What it sets out to demonstrate is that (...) interpretivism is an integralist, or nonseparatist, account of sport, one in which ethical and aesthetic values are not exclusive. Making explicit and specifying interpretivism’s combined moral-aesthetic approach to sport not only helps to better distinguish the whole range of values that make up sport as well as their interconnection but also encourages sportspeople to pursue more coherent sport and, thus, more enriching lives. Organized youth sport has become a prominent activity in Western societies, one around which myriad families structure their daily lives. Despite its popularity, or rather because of it, youth sport is besotted with complex problems. One distinctive set of problems pertains to children’s opportunities to benefit from engagement in sport. Such problems require a reflection on the conditions of justice. The goal of this paper is to explore ethical guidelines to make youth sport more just. The paper begins by characterizing (...) childhood, youth, and youth sport. Then, it articulates considerations of justice in youth sport. Together, these sections provide a basis to formulate the general features of a just youth sport. What emerges is a vision of youth sport that the adults involved in it should emphasize and implement if their young charges, and youth sport, are to flourish, as well as a novel approach to formulating and justifying normative criteria to make youth sport more just. Freire is one of the most powerful voices challenging the hegemony of bureaucratic and banking educational systems. His voice was particularly influential impacting revolutionary processes and progressive social movements while at the same time learning from their practices. However, some silences in his oeuvres requires further examination. In this article, we focus on the silences of Freire regarding education and its relationship with work and labor, gender issues, and citizenship building.

We study two ideals which are naturally associated to independent families. The first of them, denoted \, is characterized by a diagonalization property which allows along a cofinal sequence of stages along a finite support iteration to adjoin a maximal independent family. The second ideal, denoted \\), originates in Shelah’s proof of \ in Shelah, 433–443, 1992). We show that for every independent family \, \\subseteq \mathcal {J}_\mathcal {A}\) and define a class of maximal independent families, to which we refer (...) as densely maximal, for which the two ideals coincide. Building upon the techniques of Shelah we characterize Sacks indestructibility for such families in terms of properties of \\) and devise a countably closed poset which adjoins a Sacks indestructible densely maximal independent family. The contentious question of bilingual processing cost may be recast as a fresh question of code-switching (CS) strategies—quantitative preferences and structural adjustments for switching at particular junctures of two languages. CS strategies are established by considering prosodic and syntactic variables, capitalizing here on bidirectional multi-word CS, spontaneously produced by members of a bilingual community in northern New Mexico who regularly use both languages (Torres Cacoullos and Travis, 2018). CS strategies become apparent by extending the equivalence constraint, which states that (...) bilinguals avoid CS at points of word placement conflict (Poplack, 1980), to examine points of inconsistent equivalence between the languages. Such sites of variable equivalence are junctures where the word strings of the two languages are equivalent only sometimes due to language-internal variable structures. A case in point for the English-Spanish language pair is the boundary between main and complement clauses, where a conjunction occurs always in Spanish but variably in English. The prosodic distancing strategy is to separate the juncture of the two languages. Here the complement clause appears in a different prosodic unit from the main clause, disproportionately as compared both with monolingual benchmarks and with bilinguals' own unilingual English and Spanish. Prosodic distancing serves to mitigate variable equivalence. The syntactic selection strategy is to opt for the variant that is more quantitatively available and more discourse neutral. Here the preference is for the Spanish complementizer que—regardless of main or complement clause language— which is the more frequent option in bilinguals' combined experience in both their languages, whereas English complementizer that is subject to a number of conditioning factors. Syntactic selection serves to restore equivalence at sites of variable equivalence. Discovery of community CS strategies may spur reconsideration of processing cost as a matter of relative difficulty, which will depend on bilinguals' prosodic and syntactic choices at particular CS sites. Enhancement-line human genetic engineering has recurrently been targeted for bioethical discussion and is usually illustrated by examples alluding to a genetic technology that is far beyond our current possibilities. By discussing an ambitious project related to solid tumor cancers – multidrug resistance – the present paper places the question on a more realistic plane and draws bioethical conclusions to serve as guidelines in the field. The paper also establishes the inadequacy of the prevalent concept of genetic medicine as one of (...) substitution. (shrink)

According to intellectualists, the will is a rational inclination towards apprehended goodness. This conception of the will makes its acts intelligible: they are explained by (i) the nature of the will as a rational inclination, and (ii) the judgement of the intellect that moves the will. From this it follows that it is impossible for an agent to will evil as such or for its own sake. In explaining wrongdoing intellectualists cite cognitive error or the disruptive influences of the passions; (...) these considerations, however, seem involuntary and at least partly exculpatory. The intellectualist needs an account that renders wrongful actions intelligible without undermining their status as responsible. I argue that Leibniz has the theoretical tools to provide at least part of an answer to this problem. In sum, an agent is directly responsible for her wrongdoing if the cognitive error or the disruptive influence of the passions that help explain this wrongdoing do not completely undermine her acting freely; an agent is indirectly responsible for her wrongdoing if she is directly responsible for previous actions which partly resulted in her wrongdoing, even if the presence of cognitive error or disruptive influence of the passions completely undermines her acting freely. This paper offers a renewed construction grammar analysis of linguistic constructions in a diachronic perspective. The present theory, termedAgentive Cognitive Construction Grammar(AgCCxG), is informed byactive inference(AIF), a process theory for the comprehension of intelligent agency. AgCCxG defends the idea that language bear traces of non-linguistic, bodily-acquired information that reflects sémiotico-biological processes of energy exchange and conservation. One of the major claims of the paper is that embodied cognition has evolved to facilitate ontogenic mental alignment among humans. This is demonstrated by (...) the results of a corpus study in which the patterns of association between verbs, the particle UP and argument structure in Old and Middle English have been studied. The conclusion is that, similar to biological systems, the linguistic sign system displays patterns of equilibrium and non-equilibrium. In other words, while in Old English usage near equilibrium was reached through the use of a conservative set of constructional semiotic templates (attachment patterns), associated with motor modalities, Middle English displays high rates of randomness resulting in a less stable, yet distinct, system of constructional attachment. Carlos Vaz Ferreira argues that the problem of freedom is conceptually distinct from the problem of causal determinism. The problem of freedom is ultimately a problem regarding the ontologically independent agency of a being, and the problem of determinism is a problem regarding explanations of events or acts in terms of the totality of their antecedent causal conditions. As Vaz Ferreira sees it, failing to keep these problems apart gives rise to merely apparent but unreal puzzles pertaining to the nature (...) of freedom and its relation to determinism.
